Terms and Conditions

1. Applicability
These general terms and conditions apply, unless otherwise agreed, to all offers and agreements of, or with, personal counselor Naisy care and all related actions, both of a preparatory and executive nature.
The present terms and conditions also apply to all agreements with the contractor, in which third parties must be involved for the implementation.
2. Company description
Naisy Care consists of a personal guide.
Naisy Care stands for development, support, care, enhancement and retention of the qualities of their customers. Naisy Care works with the ecological system model. As a personal guide, Naisy Care supports and takes care of clients with a disability. Naisy Care work with parent (s) / caregiver (s) (hereafter referred to as: the parents) and informal care institute of the client to reduce the client’s limitation as much as possible and to create independence.
3. Definitions
a. Contractor: Naisy care
b. Client: The client
c. Agreement: An oral or written agreement between, client and contractor regarding an agreed delivery of services or goods.
4. Execution of the agreement.
a. The contractor will execute the agreement to the best of its knowledge and ability and in accordance with the requirements of good workmanship.
b. The contractor has a best efforts obligation towards the client. Never a result obligation.
5. Coaching / coaching clients with a disability
a. For children under 16 years old, if applicable, both authoritative parents must agree with the supervision.
b. The signing or instructing authoritative parent ensures that the other authoritative parent is informed about the supervision and gives his / her permission for this.
c. He / she agrees that if the other parent objects to it in any way.
6. Observation and report
A. At the request of the parent (s) / caregiver (s) (hereafter referred to as: the parents) of the client, the Kindercoach visits the school or other interested parties for observation and / or reporting.
B. Together with the parents, an estimate is made of the time required for this in advance.
C. The time spent is recorded. At the request of the customer or parents, a written report can be sent to third parties (for example, school). This report is prepared by Naisy Care. The time spent is recorded.
7. Confidential information
A. All information discussed during the sessions will be treated confidentially. In consultation with the client it can be decided to inform third parties.
B. In the event of an imminent danger for the client, contractor, specific persons or for society, the contractor reserves the right to provide relevant information to competent authorities or persons so that the danger can be prevented.
C. If the contractor is designated on the basis of a legal provision or a judicial decision to nevertheless provide confidential information to third parties, the client cannot claim any compensation or compensation from the contractor.
8. Rules regarding an appointment for the customer
session becomes at the client’s home or school. The parent must be reachable by phone during the sessions. After a session there may be a short opportunity for the parents to discuss what the client has done or made.
During an interim interview and / or final interview, the claims with regard to the client are discussed in detail. At the end of the counseling process, the client or he / she representative must receive a process log from the client.
9. Foreclosure
If the appointment is canceled at least 24 hours in advance, the time reserved for you will not be charged. If you cancel within 24 hours, the time reserved for you will be invoiced. Timely rescheduling the appointment is always possible, this can be done by email and telephone. Naisy care’s telephone is not answered while guiding customers. You can then leave your message on the voicemail. In case of cancellation due to illness, consultation is possible.
10. Rates
Client must be aware of the costs. These can be requested from Naisy Care. Short telephone consultation is free. If longer time is needed for an interview, an appointment will be made, using the rates as described.
Unless explicitly stated otherwise, all amounts are in Euros. VAT is due on all contractor’s rates.
11. Payment terms
Billing is done monthly, regardless of the result of the coach’s effort.
The parents of the client undertake to transfer the payment in full to the account of Naisy Care within 14 days after the invoice date. the agreed term is paid, Naisy Care sends a payment reminder. If the customer’s parents do not meet their obligations within 14 days after the date of the payment reminder, Naisy Care is entitled to charge an administration fee of € 5.00 per invoice for the second reminder. If, after the second payment reminder, the amount owed has not yet been credited to the account of Naisy Care by the specified date, Naisy Care is forced to transfer the claims we have on you to third parties. The costs associated with this are comfortably the law, entirely at your expense.
In the event of payment arrears, Naisy Care is entitled to suspend further treatment until the client’s parents have fulfilled their payment obligations.
12. Suspension, dissolution and early termination of the agreement
The supervisor is authorized to suspend compliance with the obligations or to terminate the agreement if the client and / or the parents do not, not fully or not timely fulfill the obligations arising from the agreement
Furthermore, the supervisor is authorized to suspend the agreement to dissolve if circumstances arise that are of such a nature that fulfillment of the agreement is impossible or if other circumstances occur that are of such a nature that the unamended maintenance of the agreement cannot reasonably be expected of the supervisor.
c) If the agreement is dissolved, the supervisor’s claims on the parents are immediately claimable.
13. Liability
Naisy Care’s advice is solution and result oriented, without guaranteeing the solution and the result. Naisy Care is never liable for direct or indirect damage or injury arising from or in connection with the services offered by Naisy Care, unless there is intent or gross negligence on the part of Naisy Care. Reimbursement to the customer and / or parents can never amount to more than the covering reimbursement according to the liability insurance of Naisy Care. For physical and psychological complaints of the client, Naisy Care recommends that you always contact your doctor.
14. Complaints procedure
Complaints prior to, during or after the services provided about the services provided must be reported in writing by the client to the contractor within 8 days after the appointment. The complaint must be provided with as detailed a description as possible, so that the contractor is able to respond as adequately as possible. If no agreement is reached, the court in the place of residence of the contractor has exclusive jurisdiction to to take cognizance of disputes.
15. Applicable law and disputes
Dutch law applies exclusively to all legal relationships. Parties will only appeal to the courts after they have done their utmost to settle a dispute in mutual consultation and through Mediation, in accordance with the NMI Regulations.
